Gift of Mele Sweepstakes (“Sweepstakes") 
Official Sweepstakes Rules 

  1. Eligibility: 

No purchase is necessary. Open to legal United States residents, 18 years of age or older as of  the date of entry. This Sweepstakes is void where prohibited by local, state or federal laws. Only  one entry per person during the Sweepstakes Period. Only one prize per household. 

  1. Sweepstakes Period:  

The Sweepstakes begins Friday, December 11, 2020 at 10 a.m. Hawaii Standard Time and ends  Friday, December 25, 2020 at 11:59 p.m. Hawaii Standard Time (“Sweepstakes Period”).  

  1. To Enter:  

Download any song from the Gift of Mele playlist of songs at  https://www.hakumagic.com/collections/gift-of-mele-international-market-place. The download is  free and no purchase is necessary. Entries are automatic with every download of the Gift of Mele  playlist. Entries via the complimentary download must be received during Sweepstakes Period to  be eligible. No e-mailed, phoned or faxed entries will be accepted. Entrants agree to be bound by  all Sweepstakes rules. 

Use of any automated system to enter Sweepstakes is prohibited and will result in disqualification.  In the case of a dispute of the owner of an online entry, the authorized account holder of the email  address used to register will be deemed to be the entrant. The “authorized account holder” is the  natural person assigned an email address by an Internet access provider, online service provider,  Internet service provider or other organization responsible for assigning email addresses for the  domain associated with the submitted address. Potential winner may be required to show proof  of being the authorized account holder. 

  1. Prize(s): 

On or about Monday, December 28, 2020, a random drawing from all eligible entries will be  conducted to select one (1) winner. Odds of winning depend on the number of eligible entries  received. The following is a description of the prize to be awarded to the winner: One (1) gift card  to an open merchant of the winner’s choice valued at two-hundred and fifty dollars. Prizes are non-transferable and may not be given, bartered or sold. There are no cash or prize  substitutes. Administrator reserves the right to substitute the prize for one of equal or greater  value if the designated prize should become unavailable for any reason. 

Winner(s) need not be present to win and will be notified by email to the email provided in the  Haku Magic checkout process. Winner will be required to sign Affidavit of Eligibility; Release and  Indemnification and complete a W-9 Form to be awarded prize. Prizes must be claimed no later  than January 31, 2021. If the prize is not claimed within such time, winner fails to meet eligibility  requirements or does not sign Affidavit of Eligibility; Release and Indemnification and W-9, then  an alternate winner will be selected. 

  1. Limitation of Liability:

By entering Sweepstakes, entrant agrees to be bound by these rules and that the decision of the  Administrator is final. Administrator will conduct the Sweepstakes substantially as described in  these rules. However, Administrator shall retain the right to abbreviate, extend, modify, or cancel  the Sweepstakes without any further obligation due to events beyond its control. 

Administrator is not responsible for incorrect or inaccurate transcription of entry information, or for  any human or printing error, technical malfunctions, lost/delayed data transmission, omission,  interruption, deletion, defect, line failures of any telephone network, computer equipment,  software, inability to access any online service or web site, inability to submit the online  Sweepstakes registration form, or any other error or malfunction, or any injury or damage to  entrant’s or any other person’s computer related to or resulting from participation or downloading  any materials in this Sweepstakes, or for late, lost, postage due, stolen, illegible or misdirected  entries. Entry materials that have been tampered with or altered are void. If, in the Administrator’s opinion there is any suspected or actual evidence of electronic or non-electronic tampering with  any portion of this Sweepstakes, or if technical difficulties compromise the integrity of the  Sweepstakes, Administrator reserves the right to void any entries at issue and/or to suspend,  modify or cancel or terminate this Sweepstakes, in whole or in part, at any time without notice and  award the prizes in a random drawing from among all non-suspect eligible entries received as of  the termination date.  

Entrants agree to release, discharge and save harmless the Administrator and The Taubman  Company LLC, their officers, directors, employees, subsidiaries and affiliates from and against  any and all injuries, liability, losses and damages of any kind resulting from entrant’s participation  in this Sweepstakes and/or entrant’s acceptance, use, misuse or possession of any prize, or lost  or misdirected prizes. Winner(s) will be responsible for all local, state and federal income taxes  associated with winning the prize(s). 

  1. General:  

Winner's entry and acceptance of the prize constitutes permission for Administrator and its  affiliates to use his/her name, photograph and likeness for purposes of advertising and promotion  without compensation. 

  1. Privacy: 

Unless an entrant has selected to “opt-in” to receive the Administrator marketing information from  Administrator on the Sweepstakes registration form or official entry blank, information collected  from entrant is used only for the purpose of the prize drawing and to notify winners, and will not  be re-used, sold or shared in any manner by Administrator or any third party. Once the  Sweepstakes, including any known or unknown extensions of the Sweepstakes has ended, all  information supplied by entrants will be removed from the database. 

  1. Winners’ List: 

For a copy of the Official Winner’s List, please mail a self-addressed stamped envelope to Gift of  Mele 2330 Kalakaua Avenue, STE 400, Honolulu, HI 96815, Attn: Winner’s List for Gift of Mele Sweepstakes.
